RESOLUTION
DECLARING LOCAL WATER EMERGENCY AND PROVIDING FOR THE IMPLEMENTATION OF PHASE I
RESTRICTIONS AND CONSERVATION
WHEREAS, the Morris County
Municipal Utilities Authority (hereinafter "MCMUA" or "Authority")
adopted regulations providing for the implementation of water conservation measures and
restrictions when prevailing circumstances in the Service Area are such that the water
supply has been depleted and the System of the MCMUA is stressed; and
WHEREAS, the MCMUA finds that:
Due to a combination of factors including
lower than normal precipitation and a consequent lowering of the potentiometric surface in
the Authority wells and unprecedented water use by the Authoritys Customers in
excess of historic use and contract allocations, a water shortage exists in the Service
Area.
The conditions outlined in the Report of the
Chief Engineer dated June 6, 2001, justify the declaration of a Local Water Emergency; and
WHEREAS, the Borough of Wharton
has applied to the Authority to be exempted from the water restrictions recommended by the
Chief Engineer due to the fact that all volumes of water purchased by Wharton are utilized
for manufacturing purposes; and
WHEREAS, the Authority concurs
in the request of Wharton for exception from the Phase I restrictions;
WHEREAS, the Southeast Morris
County Municipal Utilities Authority is not drawing water from the Authority System;
NOW, THEREFORE, BE IT RESOLVED
by the Morris County Municipal Utilities Authority in the County of Morris and State of
New Jersey on this 12th day of June, 2001 as follows:
The Authority hereby declares that a Local
Water Emergency exists in the Service Area.
The Executive Director is authorized and
directed to implement Phase I measures as follows:
Customers of MCMUA shall implement and observe
the following Adjustable Water Use measures:
the watering of lawns, shrubbery and other
plant growth as well as the washing of vehicles shall occur only on alternate days in
accordance with the schedule below:
- Odd Days: Odd numbered homes
- Even Days: Even numbered homes
the washing of streets, driveways, sidewalks,
and paved areas is banned
the automatic serving of water in restaurants
is banned although requests for water can be honored.
Within a week of the date
hereof the Customers shall submit a plan to the Authority including:
water conservation measures implemented;
an inventory of municipal water storage,
back-up supplies and interconnections;
water use restrictions implemented
Within three weeks of the date hereof and
every week thereafter the Customers shall report as to water use reductions achieved, an
assessment of the state of the water emergency within the municipality served and a
recommendation as to whether a Phase II emergency should be declared.
The Borough of Wharton is exempted from the
Phase I restrictions hereinafter implemented.
SEMCMUA is exempted from the Phase I
restrictions hereinafter implemented by virtue of its non-use of the Authority System.
This Resolution shall take effect immediately.

I hereby certify that the foregoing Resolution
was adopted by the Morris County Municipal Utilities Authority at the Regular Board
Meeting held on June 12, 2001.
